SHILLONG, DEC 3: Civil Society Women’s Organization (CSWO) on Wednesday filed an FIR with the SP (CID) Claudia Lyngwa against the West Garo hills additional SP Bruno A Sangma, SI Oksnath P Marak and SWAT personnel allegedly cold blooded murder of two youths in 2012 when Bruno was Dadenggre Sub Divisional Police Officer-SDPO.
The CSWO has sought action against the police officers and SWAT team under sections 302 (for murder), 153 (for acts being prejudicial to maintenance of harmony in the state), 201 (for causing disappearance of evidence of offence) under IPC.
The CSWO president Agnes Kharshiing says in the FIR, “In the light of evidences leading to cold blooded murder of the two youths, I urged that a case be immediately registered against the police personnel and book them under relevant sections of the IPC.”
The FIR alleged that Bruno A Sangma who was in 2012 posted as the SDPO of Dadenggre, Sub Inspector Oksnath P Marak and some SWAT personnel have killed two youths – Waistone R Marak of Dabongre and Rocky A Sangma of Dimakgre, in cold blood on August 14, 2012, at Rari, North Garo hills district.
The FIR goes on to claim that the police team led by Bruno shot the two youth as they sustained 5 to 7 bullet injuries in vital parts of the body wherein. It says that according to known facts, one bullet would have put the person to the ground referring to the post mortem report.
Stating that the police should have immediately taken the two youths for medical as soon as they were shot, but Kharshiing said in this case they (police) went ahead and pumped more bullets killing the two youths.
Kharshiing’s FIR stated, “This is an ‘extrajudicial killing’ where police have no right whatsoever to kill in cold blood and should have given the slain youth medical treatment, and a chance to stand trial, to prove their innocence as no one is guilty until proven, especially when in this case they were mere suspects, and had no criminal record.”
The FIR said the weapons of the then SDPO, SI and SWAT personnel who were part of the combined operation from West Garo hills and North Garo hills, were not taken to be sent for FSL examination, which is mandatory to determine who shot the two slain youths in police action.
The FIR alleged, “The fact that these weapons used by these police officers were not seized and sent for FSL is clear that the investigator was under pressure not to send them for examination.”
Alleging there many discrepancies that is been found, the FIR said this point to the fact that the youths were shot in cold blood. Kharshiing’s FIR also wondered why no FIR was filed against the police when a criminal act was committed on their part, which makes out a cognizable case of culpable homicide.
The FIR also pointed out that the hand wash and finger prints were not taken.
Pointing out the report of the SP North Garo hills sent to Asst Registrar (Law) on August last year, it clearly mentioned to the queries of the NHRC – “Whether finger prints of the victims alleged to have fired the weapons matches with the victims or not along with finger print experts”- that “no finger print has been taken by the Investigation Officer (IO) J Myrboh as the place of occurrence has been disturbed.”
The FIR said as per the magisterial inquiry conducted by SK Marak, ADM of North Garo hills, there were no other eye witnesses except police adding “why would an expert SDPO allow the crime scene to be disturbed unless he wanted certain facts to be destroyed.”
