SHILLONG, AUG 30: Former assembly deputy speaker Sanbor Shullai, who had recently appeal for restoration of his MDC seat in the KHADC, on Tuesday admitted that the state government has misled the legislators on the issue of holding of dual posts. “Yes (we feel we have been misled) on seeing the recent High Court’s verdict on the issue,” Shullai, also NCP legislator from South Shillong told reporters on the sideline of a meeting on Tuesday.
The recent Meghalaya High Court’s order has upheld the Governor’s order which indicated that an MLA holding the post of MDC does not attract disqualification under Article 191 of the Indian Constitution.
Shullai is also one among the few affected MLAs, who have resigned as MDCs of KHADC and JHADC, but now is seeking restoration of their seats following the court’s order.
“The fact is that we have resigned as MDCs out of compulsion following the passing of the Prevention of Disqualification (Members of Legislative Assembly of Meghalaya) (Amendment) Act, 2015 last year,” he said.
He however said that he decided to submit a letter of appeal to the state government only after seeing the court’s verdict. Earlier, former DCA minister HDR Lyngdoh had acknowledge receiving the letter of appeal and assured the issue will accordingly be examined.
When asked, Shullai said, “I personally feel that the state government should reply to us whether we are eligible to be restore or not.”
The Nationalist Congress Party (NCP) is also one of the coalition partners of the Congress led MUA-II state government in the state.
When questioned whether there is any possibility for his party withdrawing support, the former deputy speaker said, “No, because this is my personal issue and has got nothing to do with my party.”
He was of opinion that the state government may denotify its anti-dual post act.-By Our Reporter
