SHILLONG, JUNE 29: The Meghalaya high court on Wednesday directed the District and Sessions court judge of Jowai in West Jaintia hills to dispose of the case relating to the death of the then headman of Jalaphet village in East Jaintia hills.
The order of high court judge SR Sen came while disposing off a petition filed by the deceased nephew Jikham Syrti seeking the court’s intervention into the delay of the ADM to frame charges.
An FIR was filed by Jikham with the Khliehriat police station informing that on November 22, 2013 at around 2 pm, the then headman of Jalaphet village Ken Syrti and his friend Braceman Gympad were attacked by five persons armed with daos and weapons at Moopala village, while they were proceeding from Sutnga side towards Khliehriat.
As a result, the victim was badly injured and was brought to Woodland Hospital, Shillong for treatment.
A case was registered at the Khliehriat polilce station as Khliehriat P.S. Case No. 271 (11) 2013 under Section 307/241/326/34 IPC. However, on November 27, 2013, Ken succumbed to his injuries at Woodland Hospital, Shillong.
During the hearing on Wednesday, counsel for the petitioner E Nongbri submitted that the GR Case No. 305/2013 wherein charge sheet had been filed 2 years back is still pending without any cognizance.
The Court of ADM, Khliehriat did not framed the charge till date and prayed for the speedy disposal and fair trial and said the case needs to be transferred to the Court of the District and Sessions Judge, Jowai.
The counsels for the accused persons had no objection.
According to the court, the ADM, Khliehriat must take note that speedy trial of a case is the right of the accused and the court should not sit over the trial for years.
In his order issued here, Justice SR Sen said, “It is hereby ordered that GR Case No. 305/2013 be transferred to the Court of District and Sessions Judge, Jowai.”
The ADM, Khliehriat was also directed to send the record within 2 days from the date of receipt of the copy of this order.
“I direct both the prosecution and the accused to be present in the court of the District and Sessions Judge, Jowai and the Judge is directed to dispose of the matter expeditiously,” Justice Sen stated in the order.-By Our Reporter
