SHILLONG, OCT 3: The Meghalaya High Court on Monday dismissed the petition pertaining to the infamous 2009-education job scam unearthed by the CBI without any order as the case is pending in the Supreme Court.
In an order passed today, Justice SR Sen said, “I am not inclined to entertain the petition since the matter is already before the Apex Court, otherwise it will amount to judicial indiscipline.”
“Accordingly, writ petition is disposed off without any order,” he stated.
The court also directed the court master to return the progress report submitted by Investigation Officer (IO).
The petition was filed by the Civil Society Women’s Organization (CSWO) president Agnes Kharshiing seeking the court’s intervention into the inaction of state police on the FIRs that was filed with regards to the education job scam.
In her petition, Kharshiing had urged that the Laitumkhrah PS case be handed over to CBI and direct them to complete the entire investigation within a stipulated time as fixed by the court.
In the findings of the CBI, of the 350 candidates appointed as assistant teachers, 255 names were recommended by politicians.as per the findings of the CBI in its report, among the 350 candidates appointed as assistant teachers, 255 names were allegedlyrecommended by politicians including the then Education minister Ampareen Lyngdoh.
Earlier during the hearing, P Nongbri, state counsel had filed an affidavit as per direction of the court wherein in para 2 it is stated that the issue involved in this case is also pending before the Apex Court.
“That the deponent states that during the pendency of the Special Leave Petition, the instant writ application on the same cause has been filed before this Hon’ble Court praying for a direction to hand over Laitumkhrah P.S. Case No. 62 (7) of 2011 to CBI involving the same issue which is pending before the Hon’ble Supreme Court,” the affidavit stated.-By Our Reporter
