The order was passed by the division bench comprising of the Chief Justice Ajay Kumar Mittal and Justice HS Thangkhiew on June 28, while hearing a review petition filed by the state government against the Harijan Panchayat Committee/Punjabi Harijan Colony & others.
“However, it is directed that the occupants/residents of the concerned area shall cooperate in furnishing the requisite information to the State,” the order of the bench said.
During the hearing, the Advocate General (AG) appearing on behalf of the state government informed that certain information is required from the occupants/residents of the concerned area to establish their rights, if any.
The AG also stated that inspite of various requests made to them, the requisite information has not been supplied. However, the counsel for the respondents (HPC and others) refuted the aforesaid allegation.
The next hearing on the matter is scheduled to be held on August 28, for further consideration.
It may be mentioned here that the Shillong Municipal Board (SMB) had on May 31, served notices to over 300 households of the Sweeper’s Colony directing them to furnish documents before the board’s office within a month’s time, which will expire on July 3.
