SHILLONG, JUNE 13: The Meghalaya high court has quashed and set aside the recommendation made by the Meghalaya Public Service Commission (MPSC) for appointments of ten selected candidates to the posts of lecturers in Garo in the government colleges under the State education department.

“The recommendations of the private respondent (MPSC) under the impugned letter dated May 6, 2013 and the communication dated May 21, 2013 are illegal and are hereby quashed and set aside,” Justice T Nandakumar Singh said in his order on May 7, 2014.

The court found that the 10 selected candidates have not cleared National Eligibility Test (NET) which makes them ineligible for the appointment for the lecturers in Garo while the petitioner passed the NET examination conducted by the University Grant Commission and, therefore, eligible to be considered for appointment to the lecturer posts.

The order was issued following a writ petition filed by five candidates – Sengsime A Sangma, Nikme R Marak, Anitha Ch Momin, Peary D Marak and Maxian R Marak -last year as they too had applied for posts as per the advertisement published on August 21, 2012.

.The court in order stated, “Essential eligibility criteria for appointment to the posts of Lecturers in Garo cannot be relaxed through correspondences between the Education Department and the Secretary of the MPSC long after cut-off date for determining the eligibility criteria of the candidates for the posts of lecturers in Garo.”

According to the order, there is no provision for relaxation in the concerned advertisement dated 21.08.2012 for the posts of lecturers in Garo.

“In absence of power of relaxation, relaxation of the essential criteria for the posts of lecturers in Garo advertised in the advertisement dated 21.08.2012 cannot be relaxed on humanitarian ground,” the order stated.

The court said, if the essential qualifications of the candidates for the posts of lecturers in Garo are relaxed, there should be re-advertisement for the posts of lecturers in Garo mentioning the relaxed qualifications, so as to enable the candidates eligible under the relaxed qualifications also to apply for the posts.

The order further stated that “once the selection process started, there cannot be relaxation of the essential qualifications in the midst of the selection process, that too, it cannot be through official correspondences, which cannot be given effect to unless and until, those are communicated to the persons or candidates, who could apply for the post under the relaxed qualification.’- By Our Reporter

    All these political appointee big Posts in Govt Service are creating chaos and depriving many of their opportunities to get a job . MPSC has become such a notorious department and these Government servants, who play politics with the job opportunities of many being deprived, should be locked up in jail for 10 years and that will check all Govt servants playing fiddle to politicians and bureaucrats.

    I wish our state have honest and determined NGOs to fight against this stupid politicians who think that the Govt belongs to them and have every right to appoint their own ineligible relatives for all Govt jobs by neglecting the most eligible candidates..this corrupted and business minded politicians are ruining our state.
