SHILLONG, SEP 29: The Meghalaya High Court on Thursday directed the Khasi Hills Autonomous District Council (KHADC) and the Meghalaya State Pollution Control Board (MSPCB) to inspect the entire surroundings of the Umiam Lake.
“The Khasi Hills Autonomous District Council and the State Pollution Control Board should inspect the entire surroundings of the Umiam Lake and, for a start, ensure that the activities undertaken by any person do not pollute the waters in any manner,” the two-member bench said in its order passed after hearing a PIL on the matter.
The order said the said respondents claim that there are several other constructions or activities undertaken which grievously pollute the Umiam waters, including a resort by the name of Orchid run by the Meghalaya Tourism Development Corporation.
The added respondents, Philosopher Iawphniaw and Banalari Khongwar, are represented. Both were issued notices for illegal and unauthorized construction works along the Umiam Lake.
“It is submitted on behalf of such respondents that the construction works undertaken in respect of Ever Banalari and Moon View Cafe were upon obtaining due permission and sanction as applicable,” the order said.
“In view of such submission, the aforesaid respondents are directed to file their affidavits appending copies of relevant documents indicating that due permission was obtained and all applicable rules were adhered to. Such affidavits should be filed by October 12,” it added.
It was further informed that Ever Banalari has been sealed and is not being used and that the construction at Moon View Cafe has not been completed for it to be used.
“In such view of the matter, no injunction is issued in respect of the use of respective buildings,” the order said.
The next hearing will be held on October 17.
